These Terms of Service (“Terms”) govern the use of DESA SOLUTIONS INDIA services including enterprise
automation dashboards, AI-driven tools, WhatsApp CRM platforms, and custom digital solutions.
1. Acceptance of Terms
By accessing our platform or initiating a transaction, you agree to these Terms. If you are using our
services on behalf of a business, that business accepts these terms.
2. Services Provided
- Enterprise Workflow Automation & Dashboard Access
- WhatsApp Business API Integration & Messaging Services
- Gen-AI Chatbot Systems & Integration
- Specialized CRM Solutions (Oshervest / Desa Hub)
- Custom Web Development & Digital Branding Tools
3. Payment Authentication & Billing
- Secure Processing: All online payments are authenticated through secure third-party
payment aggregators.
- Verification: Service activation is subject to successful payment authentication.
Users must provide accurate billing details to ensure seamless processing.
- Taxes: All prices are subject to applicable GST as per government regulations.
4. User & Messaging Responsibilities
- You must provide valid information during the account authentication process.
- You are responsible for maintaining the security of your dashboard credentials.
- Compliance with Messaging Policies: When using our WhatsApp CRM, you agree to comply strictly with the WhatsApp Business Terms of Service and WhatsApp Commerce Policy.
- Opt-In Requirement: You are solely responsible for obtaining explicit, legally valid opt-in consent from your customers before sending them messages via our platform.
5. Third-Party Platforms (Meta & WhatsApp)
Our CRM utilizes the WhatsApp Business API provided by Meta Platforms, Inc. By integrating your WhatsApp Business Account (WABA) with our platform, you acknowledge that:
- You are bound by Meta's and WhatsApp's independent Terms of Service.
- Meta retains the right to suspend or terminate your WABA or messaging capabilities for policy violations, which is outside of our control.
- We act as a Technology Provider and are not liable for account suspensions or message delivery failures caused by Meta's infrastructure or policy enforcement.
6. Prohibited Activities
- Sending unsolicited messages (spam) or violating WhatsApp messaging limits and quality standards.
- Attempting to bypass payment authentication or security protocols.
- Using automation tools for fraudulent, abusive, or harmful purposes.
- Redistributing or selling access to the proprietary DESA platform without authorization.
7. Termination
We reserve the right to suspend or terminate access to our digital services if these terms are violated,
if payment authentication cannot be completed, or if directed to do so by Meta due to a violation of their policies.
8. Limitation of Liability
We are not responsible for:
- Technical delays in third-party payment gateway authentication.
- Service downtime caused by external infrastructure failures, including Meta API outages.
- Losses resulting from the unauthorized use of your payment credentials by a third party.
